The process of participating in an interview requires us to meet with you privately and explain the legal issues arising from your case, including the law relating to any potential violations being investigated. The crucial decision then is whether your best interests are served by answering the police’s questions, giving your account in a written statement, or simply exercising your right to remain silent by giving a “no comment” interview. Throughout the interview we will be proactive. Throughout our dealings with investigators, we will make representations as necessary and if possible to convince them that there is insufficient evidence to take the case to court.

For crimes that are considered relatively minor, the police decide for themselves whether the case goes to court. However, for anything considered serious or complex, the decision is referred to the Prosecutor for a decision.
